1. Contractual Partner
 

All services offered under Hands-on Art are provided by Mark Berger Consulting GmbH, Zug, Switzerland.
All bookings, invoices, and agreements are with the GmbH, not with any individual.


2. Scope
 

These Terms & Conditions apply to all Hands-on Art services, including:

  • Individual sessions

  • Workshops and group events

  • Creative coaching programs
     

By booking or participating, clients accept these Terms & Conditions.
 

3. Nature of Services
 

Hands-on Art provides creative guidance supporting:

  • Wellbeing

  • Self-regulation

  • Personal development
     

Important:

  • These services do not constitute medical, psychiatric, or psychotherapeutic treatment

  • No diagnoses are made and no therapeutic outcomes are guaranteed

  • Clients remain responsible for their own health

  • Clients under medical or psychiatric care should confirm participation with their healthcare provider
     

4. Participant Health & Wellbeing
 

Participation is voluntary and at your own risk.
Participants are responsible for their own physical and mental wellbeing.

If a participant feels unwell during a session, they must inform the facilitator immediately. Hands-on Art may provide reasonable assistance but is not liable for health issues or accidents during sessions.
 

5. Booking & Payment
 

  • Booking is confirmed when the participant receives a confirmation from Hands-on Art

  • All prices are in CHF

  • Payment is due within 10 days, unless otherwise agreed

  • Advance payment may be required

  • Participation may be refused in case of non-payment
     

6. Cancellations & No-Shows
 

Individual Sessions

  • Cancellation ≥ 24 hours before: free

  • Cancellation < 24 hours / no-show: 100% of fee
     

Workshops / Group Events

  • Cancellation ≥ 7 days before: free

  • Cancellation 2–6 days before: 50% of fee

  • Cancellation ≤ 48 hours before: 100% of fee
     

Substitute participants are allowed. If Hands-on Art cancels, participants receive a replacement date or full refund.
 

7. Food & Beverages
 

Coffee, tea, and small snacks may be provided during workshops. Participants consume these at their own risk.
Hands-on Art / Mark Berger Consulting GmbH is not liable for allergic reactions or health issues related to food or drinks.
Participants should inform the facilitator of any allergies or dietary restrictions before the session.

 

8. Liability
 

The Provider’s liability is limited to intent or gross negligence under Swiss law.
Liability for slight negligence, indirect damages, consequential damages, or lost profits is excluded to the extent permitted by law.

 

9. Intellectual Property
 

All materials, concepts, exercises, images, and content remain the intellectual property of Hands-on Art / Mark Berger Consulting GmbH.
No reproduction, distribution, or commercial use without written permission.

 

10. Privacy & Media Consent
 

Hands-on Art respects your privacy. Personal data collected during bookings or sessions — including names, contact details, and notes — is kept confidential and processed only for administrative purposes (Swiss nDSG).
 

Participants may be photographed, filmed, or have their artworks documented during sessions. Use for marketing, social media, website, newsletters, or promotional purposes requires separate explicit consent.

Consent is voluntary and can be withdrawn at any time. For participants under 18, consent must be provided by a parent or legal guardian.
Refusal of consent does not affect participation.

 

11. Disclaimers
 

  • Services do not replace medical or psychotherapeutic care

  • Information provided is for general purposes only

  • Hands-on Art / Mark Berger Consulting GmbH is not responsible for decisions made based on information provided in sessions
     

12. Force Majeure
 

The Provider is not liable for delays, cancellations, or modifications due to circumstances beyond reasonable control, including natural disasters, technical failures, or government restrictions.
 

13. Amendments
 

Hands-on Art reserves the right to update these Terms & Conditions. Clients are bound by the version valid at the time of booking.
 

14. Payment Default
 

In case of delayed or missing payment, Hands-on Art may:

  • Suspend participation

  • Charge interest and late fees according to Swiss law

  • Initiate legal collection
     

15. Dispute Resolution
 

Disputes will first be addressed amicably.
If unresolved, the competent court in Zug, Switzerland, has exclusive jurisdiction.

 

16. Severability
 

If any provision is invalid or unenforceable, the remaining provisions remain in effect.
 

17. Governing Law
 

Swiss law, particularly the Swiss Code of Obligations (OR), applies exclusively.
 

18. Final Statement
 

By booking or participating in Hands-on Art sessions, you agree to these Terms & Conditions. Swiss law applies.
